STOKE TRAVEL TERMS & CONDITIONS

Stoke Travel is the trading name of Sirowek S.L with company number B-65106585

"Client" pertains to all persons named on the booking form, or intending to travel with Stoke Travel.

A "product " is any service sold and offered by Stoke Travel. All clients will be deemed to have read, understood, and accept all booking conditions upon registering for a Stoke Travel product.

If the client is booking on behalf of a group, it is the responsibility of the client who books online and accepts the terms and conditions to make sure all other persons in the group have read the Terms and Conditions and have agreed to its contents

BOOKING

Stoke Travel considers a bound contract to have been formed upon the agreed deposits exchanged between the client and Stoke travel. This comes into existence when Stoke Travel has received a deposit and issues a confirmation. Stoke Travel reserves the right to refuse or decline any booking without further explanation. Clients can cancel at any time, and the cancellation will come into effect as soon as Stoke Travel receives a written request from the client. In the case of cancellation, the booking deposit is 70% refundable if cancelled 8 weeks prior to the date of expected arrival, 50% refundable if cancelled 4-8 weeks prior to the date of expected arrival, and non- refundable if cancelled within 4 weeks prior to the date of expected arrival. There will be no refunds given for reasons pertaining to weather conditions, global, national, or provincial political situation that does not directly pose a security threat to the safe operations of the tour in its specific region.

 

INSURANCE

We strongly advise bookings should not be made without adequate personal insurance, as our activities often incorporate, by nature, an element of risk. It is the responsibility of the client to have adequate travel and accident insurance to cover a minimum, but not limited to, the following: all medical expenses, including treatment, transport, and evacuation; repatriation expenses; loss or delay of luggage; and cancellation or curtailment of a product. The clients insurance should not exclude ANY planned adventure activities from the time of booking and for the full duration of the product. Therefore, clients are fully responsible for arranging their own travel insurance that covers surfing, non motorised extreme sports and they should not book without it. Stoke Travel does not accept liability on the clients' behalf in circumstances where Stoke Travel has provided a product of a reasonable standard. A client and his personal belongings are the client's sole responsibility. It is also the sole responsibility of the person booking to inform and make sure all members of their party have read, understood, and agree to these terms.

 

LIABILITY

Stoke Travel products and adventures contain an element of risk that other holidays may not contain. By accepting a Stoke Travel product under these provided booking conditions, clients are aware of the inherent risks and potential dangers of their chosen travel. Stoke Travel is not liable for any incidents that may arise at border crossings that are outside the control of Stoke Travel. Clients should be aware of regulations and laws in the countries they travel to. Stoke Travel accepts no liability for personal injury, death, or damages by the client if the reason for the claimed damages were either the client's fault or a result of circumstances beyond the control of Stoke Travel. Under no circumstances can Stoke Travel be held responsible for unsatisfactory surf/snow conditions, including weather, adverse climate conditions, or other natural conditions out of Stoke Travel´s control. Stoke Travel also accepts no liability for additional costs to the client that may occur through delay, accident or disruption of the product beyond the control of Stoke Travel.
The client agrees to pay for any damages caused by the client to the facilities or equipment of Stoke Travel, their employees, and any third parties that provide services for Stoke Travel. The client is obligated to pay the expenses, by whatever means possible, before departure of the site.

 

LOST AND STOLEN PROPERTY

 Stoke Travel will not be held responsible for any theft or loss of personal possessions from our premises or vehicles. Whilst Stoke Travel will strive to ensure the security of guests' personal possessions, Stoke Travel cannot guarantee it. Again, it is the responsibility of the client to be in possession of, and be responsible for money, valid passports, visa permits, vaccinations and preventative medicines, and any other necessary travel documents. Your personal travel insurance should cover this.

 

TRANSPORTATION

Stoke Travel provides free transportation services to certain destinations for your convenience. The use of these vehicles is taken entirely at your own risk, and Stoke Travel take no responsibility for death or personal injury caused through the use of this service.

 

ACTIVITIES & EXCURSIONS

Stoke Travel organizes a variety of optional activities and excursions at some of its destinations. Activities, excursions and their prices can be subject to change, without prior notice.

Clients partake in activities and excursions on a voluntary basis and always at their own risk. Stoke Travel is not liable for damages caused whilst on, or participating in, activities and excursions. 

 

SPORTS

Depending on weather and wave conditions, surf trips sometimes cannot take place. Stoke Travel will try to organize other trips/activities to replace cancelled trips and lessons. The cancellation of surf trips and lessons due to circumstances beyond the control of Stoke Travel will not result in complaints. All other surf adventure and van trips are provided along with experienced surfers, but clients participate in all activities at their own risk. 

HEALTH & SAFETY

Stoke Travel promotes good hygiene practices, but the hygiene standards in some foreign countries, particularly developing destinations, are generally much lower than in the US and Europe. Care should be taken to minimise the risk of holiday sickness, especially among pregnant women, infants and the elderly.

 

While Stoke Travel aspires to assist in any health problem that may arise during your trip in countries where the public health care appears below what Stoke Travel deems reasonable, Stoke Travel will, where possible, use private hospitals and ambulance services. Costs for these services will normally be covered by your travel insurance. If this is not the case, the client will be held responsible for costs of there health care.

Costs that arise directly for Stoke Travel for these services will be invoiced to the client. It is then the customer's responsibility to claim back from their insurance. 

ASSISTANCE AND GUIDES

Stoke Travel provides guides in some of its packages. These guides, although experienced in the advertised adventure, are not always licensed instructors in their field. By accepting the terms and conditions, the client understands that although he/she and the members in the group may receive tips from these guides, the client is not receiving qualified instruction.

 

PEAK AND LOW SEASON

In low season tourist regions and tourist operators are often preparing their organizations for high season. Therefore some bars, shops, restaurants, activities and excursions are not yet available. Stoke Travel is not liable for those circumstances.

 

ACCOMMODATION

When you book more beds, rooms, apartments or tents at the same time (under the same group name), Stoke Travel will strive to reserve those next to each other. Unfortunately, this cannot be guaranteed. In such an event you may be placed in individual accommodation or with anonymous client(s).

 

PHOTOGRAPHY AND VIDEO

 Our authorized representatives may take photographs and films of our clients while using any Stoke Travel product. By agreeing to these terms and conditions, Stoke Travel reserves the right to use said material for any advertising or promotion without obtaining further consent. Stoke Travel also reserves the right to use any comments clients make, questionnaires or complimentary letters with respect to Stoke Travel or its products in promotional literature without obtaining further consent. 

COMPLAINTS

 In the unlikely event the client has a complaint about any of the product arrangements, the client must raise the complaint immediately with a Stoke Travel employee so that Stoke Travel can strive to rectify the problem. Stoke Travel cannot rectify a problem if they are unaware. Stoke Travel are not prepared to compensate complaints made after the departure of guests.
